1. Acceptance of Terms

By accessing or using CRE VIPER Appeals (the "Software" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use this Software.

2. Nature of Service

CRE VIPER Appeals is a software application that provides preliminary property tax evaluation using income capitalization methodology. This Service:

  • Is NOT an appraisal or appraisal service
  • Is NOT a professional services engagement
  • Provides automated calculations for informational purposes only
  • Does not create any professional-client relationship

3. User Responsibilities

By using this Service, you agree to:

  • Provide accurate and truthful information
  • Use the Software only for lawful purposes
  • Not misrepresent results as formal appraisals
  • Consult qualified professionals before taking action based on results
  • Not attempt to reverse engineer, decompile, or extract source code
  • Not use the Software to harm, harass, or defraud others

4. Limitations on Use of Results

Results from this Software are preliminary estimates for informational purposes only. You agree that:

  • Results are not formal appraisals or opinions of value
  • Results should not be relied upon for legal, financial, or official purposes without professional consultation
  • You will not represent results as USPAP-compliant appraisals
  • Formal appraisal by a licensed appraiser is recommended before filing property tax appeals

5. No Professional Services Relationship

Use of this Software does NOT create any professional services relationship, including but not limited to appraiser-client, consultant-client, attorney-client, or advisor-client relationships. The developer of this Software is not providing appraisal services, legal advice, tax advice, or professional consulting through this tool.

6. No Attorney-Client Relationship

CRE VIPER is NOT a law firm and does not provide legal advice, legal representation, or attorney-client services of any kind. No attorney-client relationship is created by your use of this Service. The documents generated by this tool are self-help templates prepared by the user, not by an attorney.

7. Self-Help Document Preparation Only

This Service provides self-help document preparation tools that allow property owners to prepare their own appeal documents for pro se (self-represented) filing. You are responsible for:

  • All information entered into the tool
  • Reviewing and verifying the accuracy of generated documents
  • Determining whether the documents are appropriate for your situation
  • Filing documents with the appropriate authorities
  • Representing yourself at any hearings or proceedings

8. No Representation

CRE VIPER does not represent you before any government body, board of review, tax tribunal, or court. You are solely responsible for presenting your case. We do not attend hearings, file documents on your behalf, or communicate with any government agency regarding your appeal.

9. Consult an Attorney

We strongly recommend consulting with a licensed attorney in your jurisdiction before filing any property tax appeal, especially for complex cases, high-value properties, or matters involving legal disputes. If you are unsure whether self-representation is appropriate for your situation, seek legal counsel.

10. No Guarantee of Results

CRE VIPER makes no guarantee that using this tool will result in a reduction of your property tax assessment. Appeal outcomes depend on many factors beyond the scope of this tool, including local board discretion, the strength of your evidence, market conditions, and applicable law. Past results referenced in marketing materials are illustrative only and do not guarantee future outcomes.

11. State-Specific Limitations

Property tax appeal procedures, requirements, and permitted activities for non-attorneys vary significantly by state. Some states may restrict who can prepare property tax appeal documents for others. By using this Service, you acknowledge:

  • You are preparing documents for your own use (pro se filing)
  • You have reviewed your state's requirements for property tax appeals
  • Certain states may require official forms, specific filing procedures, or attorney involvement
  • CRE VIPER is not responsible for ensuring compliance with your jurisdiction's specific requirements

12. Intellectual Property

All content, features, functionality, and methodology of this Software are owned by CRE VIPER and are protected by copyright, trademark, and other intellectual property laws. You agree not to:

  • Copy, modify, or create derivative works of the Software
  • Reproduce, distribute, or publicly display the Software without permission
  • Use automated tools to access or extract data from the Software
  • Remove or alter any proprietary notices

13. Data and Privacy

By using this Service, you acknowledge that:

  • Property information you enter may be stored for service improvement
  • We do not sell or share your personal information with third parties
  • Email addresses collected are used solely for authentication and service access
  • We implement reasonable security measures but cannot guarantee absolute security

14. Disclaimer of Warranties

THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of information or results
  • Uninterrupted or error-free operation
  • Freedom from viruses or other harmful components

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRE VIPER AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM USE OF THIS SOFTWARE, INCLUDING:

  • Direct, indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from reliance on information provided by the Software
  • Damages from errors, omissions, interruptions, or defects in the Software

This limitation applies even if we have been advised of the possibility of such damages.

16. Indemnification

You agree to indemnify and hold harmless CRE VIPER and its developers from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Software; (b) your violation of these Terms; or (c) your violation of any rights of third parties.

17. Geographic Limitations

Commercial property tools are designed for properties in Michigan and Ohio. Residential appeal letter tools are available for all 50 US states. Results may not be accurate or applicable for properties outside supported jurisdictions.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Software after changes constitutes acceptance of modified Terms.

19. Termination

We reserve the right to terminate or suspend access to the Software at any time, without notice, for any reason, including violation of these Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes shall be resolved in courts located in Michigan.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

22. Entire Agreement

These Terms constitute the entire agreement between you and CRE VIPER regarding use of this Software and supersede all prior agreements and understandings.

Note: CRE VIPER is under active development. Features, functionality, and pricing may be modified at any time. By using this Service, you acknowledge and accept the inherent nature of evolving software, including potential bugs and service interruptions. We make no guarantees regarding uptime or feature availability.
